NORTHVILLE, Mich.--(BUSINESS WIRE)--Mems Technology Berhad (“MemsTech”) announced on June 15, 2009 that the U.S. International Trade Commission (“ITC”) has issued its Final Determination affirming the January 12, 2009 Initial Determination by the Administrative Law Judge in the ITC investigation based on Knowles Electronics LLC's complaint pursuant to section 337 of the Tariff Act of 1930. MemsTech intends to appeal to the U.S. Court of Appeals for the Federal Circuit, and is confident of ultimately receiving a favorable ruling.

Significantly, the ITC’s Final Determination affirms the Initial Determination that none of MemsTech’s current silicon microphone products are covered by the ruling. The ITC’s Final Determination covers only obsolete MemsTech silicon microphone products that MemsTech is no longer producing or selling to its customers.

“While this development is disappointing, we are very pleased that the ITC’s ruling will not impact any of our current silicon microphone product offerings or our customers’ ability to import products into the U.S. that contain MemsTech’s silicon microphones,” said K.Sooriakumar, Chief Executive Officer of MemsTech. “Therefore, this ruling will not impact our ability to conduct our business in normal fashion.”
